Section 4 - Products and Services

Many of our products are custom, personalized, engraved, printed, cut, or made-to-order. Because of this, customers are responsible for reviewing all personalization details carefully before placing an order.

Personalization details may include, but are not limited to:

  • Uploaded photos

  • Uploaded artwork

We are not responsible for customer-submitted errors, including misspellings, incorrect dates, incorrect names, low-quality uploaded images, inaccurate shipping addresses, or incorrect customization selections.

We reserve the right to refuse, cancel, or request changes to any order that includes content we determine to be unlawful, hateful, threatening, abusive, obscene, infringing, misleading, or otherwise inappropriate.

Section 5 - Customer-Submitted Images, Artwork, Logos, and Text

If you upload or submit images, artwork, logos, names, text, phrases, or other content for use in a custom product, you represent that you own the content or have the necessary rights, licenses, permissions, or consent to use it.

By submitting content to us, you grant The Grinning Duck LLC permission to use that content solely as needed to design, produce, fulfill, support, remake, or resolve issues related to your order.

You agree that your submitted content will not violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.

We are not responsible for claims arising from customer-submitted content. You agree to indemnify and hold The Grinning Duck LLC harmless from claims related to content you provide for customization.

 

Section 6 - Refusal of Custom Content and Orders

The Grinning Duck LLC reserves the right to refuse, cancel, or request changes to any order, design, personalization request, uploaded file, image, artwork, logo, phrase, or other submitted content at our discretion, to the fullest extent permitted by law.

We may refuse or cancel custom requests that we determine to be:

  • Hateful, racist, discriminatory, or demeaning toward any person or group

  • Harassing, bullying, threatening, abusive, or intentionally harmful

  • Obscene, sexually explicit, graphically violent, or otherwise inappropriate

  • Promoting violence, self-harm, illegal activity, or dangerous behavior

  • Infringing on another person’s or company’s copyright, trademark, privacy, publicity, or other rights

  • Misleading, fraudulent, impersonating another person or business, or falsely implying endorsement

  • Politically inflammatory, targeted toward a private individual, or connected to highly controversial subject matter that we do not wish to produce

  • Otherwise inconsistent with our business values, brand standards, safety concerns, or legal obligations

We are not obligated to produce any custom design or product that we determine may create legal, safety, reputational, ethical, or business concerns.

If an order is refused or cancelled before production begins, we may issue a refund. If production has already started, refund eligibility will be determined based on the circumstances, the work already completed, and our Return and Refund Policy.

Our decision to decline a custom request is based on the content of the request and does not permit unlawful discrimination against customers.

 

 

Section 7 - Product Appearance, Materials, and Variations

We make every reasonable effort to display product colors, materials, engraving, printing, and images as accurately as possible. However, we cannot guarantee that your device or monitor will display colors accurately.

Because many products are handmade, personalized, laser-engraved, printed, or created using natural materials, small variations may occur. These may include differences in wood grain, slate texture, engraving tone, acrylic appearance, print placement, color, depth, finish, or other natural or production-related variations.

These variations are part of the custom-made nature of the products and do not necessarily qualify as defects.

Section 8 - Design Proofs, Previews, and Customer Approval

Some products may include digital previews, mockups, personalization previews, or design proofs. These are intended to help visualize the design, but they may not perfectly represent the final engraved, printed, or finished product.

If a proof or approval is requested before production, delays in customer response may delay processing and shipment.

Once a design is approved or once production begins, changes, cancellations, refunds, or exchanges may no longer be available except as described in our Return and Refund Policy.

Section 9 - Pricing, Availability, and Changes

Prices for our products are subject to change without notice.

We reserve the right to modify or discontinue any product or service at any time without notice.

We reserve the right to limit the quantities of any products or services that we offer. We may limit or cancel orders at our discretion, including orders that appear to be placed by dealers, resellers, distributors, or for unauthorized purposes.

All offers for products or services on this site are void where prohibited.

Section 10 - Orders, Billing, and Account Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all purchases made through our store.

You agree to promptly update your account and contact information so we can complete transactions and contact you as needed.

We reserve the right to refuse, cancel, or modify any order you place with us. If we make a change to or cancel an order, we may attempt to notify you using the email, billing address, shipping address, or phone number provided at the time the order was placed.

Processing times and shipping estimates are provided for general guidance and are not guaranteed unless expressly stated.

Shipping carriers may experience delays outside of our control. We are not responsible for carrier delays, weather delays, customs delays, incorrect shipping addresses provided by the customer, or other delivery issues outside our control.

Customers are responsible for providing accurate shipping information at checkout. If an order is returned, delayed, or lost due to an incorrect or incomplete address provided by the customer, additional shipping charges may apply.

Section 12 - Returns, Refunds, and Cancellations

Because many of our products are personalized, custom-made, or made-to-order, returns, refunds, exchanges, and cancellations may be limited.

Orders may not be eligible for cancellation once production has started.

Personalized, engraved, printed, or custom-made products are generally final sale unless they arrive damaged, defective, or incorrect due to our error.

Customers are responsible for following any product care instructions provided with their order or listed on the product page.

The Grinning Duck LLC is not responsible for damage caused by misuse, improper care, mishandling, dropping, exposure to unsuitable conditions, unauthorized modification, or normal wear and tear.

Some products may include glass, metal, wood, acrylic, slate, small parts, sharp edges, or fragile materials. Please use care when handling products and keep items away from children or pets where appropriate.
